Upon request, the college will provide a copy of this policy in an alternate format.


The purpose of this policy is to define appropriate and safe of usage hand operated electronic devices by College employees while operating motor vehicles(including personal vehicles) to conduct College-related business.


The Highway Traffic Amendment Act defines hand-operated electronic devices as:

  1. a cellular telephone
  2. another electronic device that:
    1. includes a telephone function and
    2. is normally held in the user's hand during use or requires the user to use his or her hand to operate any of its functions;
  3. an electronic device that is not otherwise described in clause a) or b) but that:
    1. is capable of transmitting or receiving e-mail or other text-based messages, and
    2. is normally held in the user’s hand during use or requires the user to use his or her hand to operate any of its functions.


College employees are prohibited from using a hand-held electronic device while operating a vehicle on College‐related business unless:

  1. before using the device by hand, the employee safely drives the vehicle off the roadway and keeps the vehicle stationary while using the device; or
  2. the device
    1. is a cellular telephone or other device that includes a telephone function, and
    2. is configured and equipped to allow hands-free use as a telephone and is used in a hands-free manner.


As an exception The Highway Traffic Amendment Act allows an employee to use a hand-operated electronic device by hand to call or send a message to a police force, fire department or ambulance service about an emergency. All supervisory staff shall be responsible for complying with this policy and ensuring their staff are aware of and comply with this policy.
